1. Acceptance of Terms

By accessing or using the OBSIDEON platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including agencies, team members, and anyone who accesses the platform.

2. Description of Service

OBSIDEON is a software-as-a-service (SaaS) platform that provides SEO tools, content generation, local SEO management, AI visibility monitoring, reporting, and automation capabilities for marketing agencies and professionals.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Subscription and Payment

  • OBSIDEON operates on a per-client-seat subscription model. Pricing is based on the number of active client seats and your billing tier.
  • Payments are billed monthly or annually in advance. All fees are non-refundable except as required by law.
  • We may change our pricing with 30 days’ notice. Price changes do not affect the current billing period.
  • If payment fails, we may suspend access to the Service until payment is resolved.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or to violate any laws.
  • Attempt to gain unauthorized access to any part of the Service.
  • Use the Service to generate spam, malicious content, or misleading information.
  • Reverse engineer, decompile, or disassemble the Service.
  • Resell or sublicense access to the Service without our written consent.
  • Exceed reasonable usage limits or abuse API access.

6. Your Data

You retain ownership of all data you input into the platform (“Your Data”). You grant us a limited license to process Your Data solely to provide the Service. We will not access, use, or share Your Data for any purpose other than operating the platform, except as described in our Privacy Policy or as required by law.

7. AI-Generated Content

The Service uses artificial intelligence to generate content, recommendations, and automated actions. While we strive for accuracy, AI-generated outputs may contain errors. You are responsible for reviewing and approving all AI-generated content before publication. OBSIDEON is not liable for any consequences of publishing AI-generated content without review.

8. Third-Party Integrations

The Service may integrate with third-party platforms (WordPress, Google Business Profile, Search Console, etc.). These integrations are governed by the respective third party’s terms. We are not responsible for the availability or performance of third-party services.

9. Limitation of Liability

To the maximum extent permitted by law, OBSIDEON shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

11. Termination

You may cancel your subscription at any time from your account settings. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for 30 days after termination.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the platform. Continued use of the Service after changes constitutes acceptance. If you disagree with the updated Terms, you may cancel your subscription.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Florida.
